RateCity Promotional Terms and Conditions

SCHEDULE TO RATECITY PROMOTION GENERAL TERMS AND CONDITIONS

Promotion name: “RateCity Community Survey” Competition (“Promotion”)

This Promotion Schedule is incorporated into and forms part of RateCity’s “General Terms and Conditions of Promotions”, available at https://www.ratecity.com.au/terms-of-use. The General Terms and Conditions apply to the Promotion subject of this Promotion Schedule. To the extent of any conflict between this Promotion Schedule and the General Terms and Conditions, this Promotion Schedule will prevail.

1. Promoter

RateCity Pty Limited ABN 12 122 743 542, Level 3, 52 Alfred Street South, Milsons Point, NSW 2061, Australia.

2. Promotion Period

This Promotion commences at 6:00am AEST on Thursday April 18 2024 and closes 5:00pm AEST on Sunday May 5 2024.

This Promotion will be advertised during this period across RateCity newsletters.

3. How to enter

Entry is only open to Australian residents who are 18 years and over and who do not reside in South Australia. Only one entry per person is allowed, entries with plus addresses will not be counted.

To enter the Promotion, Entrants must fully complete the relevant survey.

4. Inclusions or exclusions

As per the General Terms and Conditions.

People who reside in South Australia are not eligible to enter the Promotion.

5. Details of Prize and value

The winning Entrant of the draw (“Winning Entrant”) will be entitled to receive a $500 Prezzee gift voucher, subject to eligibility (“Prize”). There will be one Prize only for this Promotion. The Promoter may, at its discretion, substitute the Prize (or a portion of the Prize) depending on availability, for a similar Prize of equal or greater value subject to any written directions of a regulatory authority. No part of a Prize is exchangeable, redeemable for cash or any other prize, or transferable, unless otherwise specified in writing by the Promoter.

6. Draw date, time and location

The Winning Entrant will be randomly selected from a list of eligible entrants. The draw will take place at 12:00PM AEST on Tuesday 7 May 2024 at Level 3, 52 Alfred Street South, Milsons Point, NSW, 2061.

The Winning Entrant will be notified by their nominated email no later than 5:00PM AEST on Thursday 9 May 2024. The Prize Winner must claim their Prize within five (5) business days of being notified by RateCity.

In order for the Winning Entrant to claim their Prize, they must notify RateCity via email reply within five (5) business days of RateCity emailing to notify them that they are the Winning Entrant. The Winning Entrant must confirm in the email response of their:

  • acceptance of the Prize,
  • full name,
  • contact phone number,
  • postcode,
  • year of birth.

Where the Winning Entrant has provided these details within the timeframe, the Prize will be delivered to the Winning Entrant via Prezzee to their validly nominated email address.

Should the Winning Entrant not claim their Prize within five (5) days of being notified (that being at most, by 5:00PM AEST Thursday 16 May 2024), RateCity may, at its discretion, re-determine a new Winning Entrant by a random computerized draw, or discontinue the Promotion. If a re-draw occurs, the draw will take place at 12:00PM AEST on Tuesday 21 May 2024 at Level 3, 52 Alfred Street South, Milsons Point, NSW 2061. The Winning Entrant of the re-draw will be notified by nominated email no later than 5:00pm AEST on Thursday 9 May 2024. The Winning Entrant of the re-draw must claim their Prize within five (5) business days of being notified by RateCity (that being, 5:00pm AEST on Thursday 30 May 2024). Should the Winning Entrant of the re-draw not claim their Prize by this time, the Promotion will be discontinued.

7. Personal Information

  • Under the Privacy Act 1988 (Cth), the Promoter must tell Entrants when it collects personal information about them and how it plans to use it.
  • If an Entrant chooses to enter or take part in the Promotion, the Entrant may be required to provide the Promoter with personal information such as the Entrant’s name, email address, age and postcode. The Promoter may use this information for future marketing purposes regarding its products, including contacting the Entrant electronically. The Promoter collects personal information about Entrants to enable them to participate in this Promotion and may disclose the Entrants’ personal information to third parties, including its contractors and agents, prize suppliers and service providers, to assist in conducting this Promotion, and to the State and Territory lottery departments as required under the relevant lottery legislation.
  • Any personal details provided incorrectly to the Promoter may be deemed by the Promoter as an invalid submission.
  • Throughout the Promotion Period, the Promoter may at their absolute discretion contact some Entrants via email to further discuss the details of that person’s entry. Any contact is not indicative of an Entrant’s standing in the competition, and does in no way indicate whether or not that Entrant has been selected as a contestant/finalist/winner.

8. Limitations and Conditions of e-gift card

  • The e-gift cards will be distributed by a third-party provider, Prezzee. Your registration details (full name and email address) will be provided to Prezzee to allow Prezzee to distribute the e-gift card to the Winning Entrant. Please review our Privacy Policy which provides information on how RateCity looks after personal information (including distribution to third parties).
  • By entering a Promotion, you authorise the Promoter to provide your personal information to Prezzee.
  • RateCity reserves the right to verify the validity of the provided email addresses. If the provided email address is found to be invalid or results in bounced emails during the course of the Promotion, the offer will not be fulfilled. It is the responsibility of participants to ensure that their email addresses are up-to-date and capable of receiving communications from RateCity.
  • By entering the Promotion, you agree to be bound by the applicable General Terms and Conditions of Prezzee found here; the Prezzee Smart eGift Card Terms and Conditions found here; and these terms and conditions.
  • The Winning Entrant must click on the link in the email by 30 June 2024 to activate the e-gift card. If you do not activate the e-gift card by 30 June 2024, the e-gift card will expire.
  • The Winning Entrant can exchange the e-gift card for up to any five retailer Gift Cards of your choice. The e-gift card has an expiry date of 30 June 2024 for users to redeem their gift. Once the new gift card has been selected new expiry dates will be set and terms and conditions apply to the specific Retailer Gift Card https://www.prezzee.com.au/doc/terms-of-sale/.

    9. Additional conditions
  • Clause 31 of the General Terms and Conditions will be replaced by the following clause: The Prize Winner will be notified by email by no later than 5:00PM AEST on Friday 16 May 2024.
  • The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought, as tax implications may arise as a result of accepting a prize.
  • The Promoter and its associated companies may use Entrants’ names and submission contents for any commercial purpose, including future promotional, marketing and publicity purposes, for an unlimited period without remuneration.
  • By entering the Promotion, each Entrant agrees to be bound by the General Terms and Conditions, read in conjunction with this Schedule, and agrees to the terms of RateCity’s Privacy Policy.
  • Nothing in this Schedule or the General Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, RateCity (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
  • RateCity reserves the right to extend or withdraw this offer at any time at its sole discretion, modify and amend these terms and conditions from time to time during the Promotion upon notice to you.
